ADA Compliance -- Sec.36.403 Alterations: Path of travel

I work for the DOT in Baltimore, MD.

I have a question regarding the need for ADA compliance based upon the following situation:

An existing roadway is to be streetscaped and resurfaced. Building Faces extend to the ROW. The existing cross-slope on one of the sidewalks is at least 8% from the face of building to curb. In order to obtain a 2% cross-slope on the sidewalk, we will have to reconstruct the roadway.

1) Do we need to make the cross-slope 2% to be compliant?

2) Can we apply for an ADA Exception based on Disproportionality? The cost to reconstruct exceeds 20% of the cost to resurface.

How wide are the sidewalks? If they are 8' wide, you could provide a 5' accessible route, and a steeper 3' buffer.

The Access Board provides technical assistance. Why not ask them directly?
