We are using the FIDIC 1999 type of contract.
Has anyone successfully agued for an extension of time based on late payments by the employer.
If so, how were you able to justify a slow down in your work activity.
We have been paid late and are now 4 months behind schedule caused mainly by late payments and cash flow problems with these late payments. How do we justify an extension of time to avoid being hit with Liquidated damages. Can we claim for all 4 months or have you send a reasonable % used for these type of delays.
