Code scope for full vacuum jacketed storage tank

Dear all,
I want some clarifications/confirmation regarding one vessel (storage tank) which is open to atmosheric side but it is covered by jacket in which full vacuum.
Refer attached figure.

So here full vacuum (outside atm pressure) is not exceeding 15 psi pressure. So can i apply rule as per ASME sec. Viii Div 1_ U-1 (b)(2)(-h)(-1) and can exclude vessel from code scope....?

Please give clarification for opinions...

KEJUL, see U-1 (c)(2)(h)(2). Have you considered static head on your inner vessel of 800 (units unknown) diameter?

The problem with sloppy work is that the supply FAR EXCEEDS the demand

No need to consider static head pressure because as per U-1(b)(2)(-h) " vessel not exceeding design pressure at top of the vessel".. so at this stage no need to consider static.. n this clause is regarless of diameter also.
