do you need ul lisiting to sell a product like a tankless hot water heater in the US

UL or CSA or TUV or ETL or METlab or....

The actual code requirement will be a listing by a nationally-recognized testing lab (NRTL).

Do your marketing research -- see what labs other than UL might be acceptable to the authorities in your market area, or else just choose UL and get to work.

I doubt if any retailer would carry such a product without a UL or other testing lab approval. If you want to sell them out of the back of your truck, you probably can.

If there are other similar products with UL approval, the local electrical inspectors are likely to reject it out of hand.

In general, CE doesn't count in the US. It's not a listing by an NRTL. CE is a manufacturer's claim -- they may or may not have had an NRTL do the inspection and testing.

Inspectors will look for a listed product that they can verify.

At the very least...
You need be listed to UL 499 as well as any applicable NEC codes. Your best option is to call a NRTL and discuss the necessary standards your product needs to meet to enter the US market.

 
I picked up a string of Christmas lights a couple of years ago and realized there was no UL stamp on the box or tagged on the lights after they burned out.
 
For a tankless hot water heater you might also require FM per insurance underwriter requirements.
