There is clear definition for maximum capacity in API 650 5.2.6.2

How about nominal capacity? Does nominal capacity equal to maximum capacity for a tank?

Usually, nominal capacity would be taken as the capacity to the top of the shell.
 
If this question is related to dike capacity or secondary containment, 40CFR112 SPCC says "Storage capacity of a container means the shell capacity of the container."
