Existing building change of occupany - NFPA 13R or 13D

One of my clients owns a 2 story apartment building with 5 apartment units. The first floor used to be a dental office but he moved his office and wants to convert the space to another apartment. The city has agreed that he only needs to provide a sprinkler on the first floor in the area undergoing the change of occupancy. I spoke with a sprinkler design company and they are saying the 13R regulations need to be followed because of the number of apartment units in the whole building. Is this true or can the change of occupancy area follow the 13D regulations because it is only 1 apartment unit?

13 d for single family

Apartments outside the scope, plus you would have to get the ahj to approve it.



NFPA 13D: DOCUMENT SCOPE
1.1* Scope. A.1.1 NFPA13D is appropriate for protection against fire hazards only in one- and two-family dwellings and manufactured homes. Residential portions of any other type of building or occupancy should be protected with residential sprinklers in accordance with NFPA 13 or in accordance with NFPA 13R
