heat exchangers with non-code side

We are building a heat exchanger in which the shell side is built to asme code sec viii-1 and the tube side is exempt by U1c2f. I've come from a HX shop that always code stamped both sides even if exempt, but that is not the standard here. They are designed to code, but the standard is to exempt whenever possible. Anyways, in filling out the MDR U-3 for a vessel like this, do I also need to fill out a U-5? Same question, but if the tube side is code and the shell side is not?
