A proposed building is planned in which there will be a 250 gallon tote of 70% HNO3 - class II Oxidizer (Use-closed system) and 55 gallons (use-open system). There is no sprinkler system or fire wall/enclosure for the tote. The open system use will have ventilation. My question is since there is ventilation for the open system, can the 250 gallon tote still be located such that there is no enclosure? Or is 250 gallons total the maximum quantity allowed (for both closed and open)regardless of the ventilation system.

Maximum Allowable Quantity sets the limit before becoming a room or area is classified as Group H occupancy. Your 250 gallon IBC of storage exceeds the 250 pound MAQ for Class 2 oxidizers. At 70% by weight and at 20C, the liquid has a density of 9.7 pounds/US gallons. One 250 gallon IBC is about 2,425 pounds of Class 2 oxidizers.

Your condition creates a Group H-3 occupancy.
