LIPA files $70M suit against PSEG-LI, alleging 'grossly negligent' storm response

This week, LIPA filed a breach-of-contract lawsuit against grid operator PSEG Long Island in an unprecedented move that puts a price tag on the NJ-based company’s "grossly negligent" performance during Tropical Storm Isaias: at least $70.
[sub]KEY CHARGES LAWSUIT ISSUES:
1) PSEG failed to properly design and maintain computer and telecom systems, or have a backup plan in case they failed
2) Nearly 30% of trucks dispatched after Isaias were to locations that didn’t require a repair
3) PSEG’s sister utility in NJ has since abandoned the failed computer system it led LIPA to upgrade to in June
4) PSEG’s Long Island customers’ interests are given lower priority than those in New Jersey.

The winner of a negligence case is usually who is the better attorney or did they pick a naive enough jury that it can be swayed by emotions? I've experience as a juror on a long trial where the accused was convicted of "Negligence". It's a very subjective term.

As it applies to engineering services...it's always best to have cut and dried full back up for everything you do. Cause if it ever goes to Court you don't know what will happen.
