Wondering if anyone has heard of using barrier beach, coastal beach, coastal dunes, etc... towards meeting required area for nitrogen loading (site requires a well) regarding Title V. We are arguing that MA colonial property laws state that on coastal land, property rights extend to mean low water (MLW) or +/- 1600' whichever is less. Using that additional land, provides enough area to meet nitrogen loading requirements for the site. Also wondering if anyone has heard of any restrictions on the land use granted under these MA colonial property laws.

Doesn't sound promising to me. Pollution from septic systems near beaches is problem enough without stretching it by considering land below high water as usable disposal area. Most State environmental laws, especially those for water supplies and sewage disposal, apply to private property and I would hope that any court challenge to the contrary would be unsuccessful.
 
I always thought the solution to pollution was dilution.
