NFPA 70E and OSHA

NFPA 70E covers electrical maintenance safety. The new version (2003) has a greatly modified section on arc-flash protection.

My question is whether or not NFPA 70E has been adopted by reference by OSHA or by other agencies that would legally require its use?

That's an interesting question and one that I've been wondering myself for awhile. I'm still convinced though that the authority having jurisdiction would make the determination via what revision of the code they're using. Where I reside, they are still on the '96 edition of the code, but we're considering at our plant to implement some measures of the 2003 code regarding labelling of MV electrical equipment with regard to arc-blast.
