Phi cv or Peak

We are checking a 15m high clay fill embankment with material properties of phi peak=25 degrees (from S' t' plots) and phi cv =23 degrees, which appears to be based on PI. c' has been specified as 1kPa in both cases. UK practice seems to suggest using the phi cv value in design but, if this is the case, should you still apply a partial factor of 1.25 to tan phi?
