Question on 2007 Release of ASME Sec VIII Div 1

If i enter a contract on December 15 2007, with user of pressure vessel, who specifies that latest edition of ASME Sec VIII Division 1 needs to be applied, should i use ASME Sec VIII Div 1 2007?

Normally, when an addendum or Edition of an ANSI Standard (like ASME) is issued, it is optional to use up until 6 months after the publication date. After the 6 month publication date, the new Edition or Addendum becomes mandatory.

I believe you are asking which ASME Section VIII-1 Code Edition/Addenda was mandatory at the time of the contract date, which was December 15, 2006 and not 2007?

On 12/15/06, the 06 Addenda to the 04 Edition was mandatory.

This information is contained in the Foreword of each Code. Words that state the following...........

After Code revisions are approved by ASME, they may
be used beginning with the date of issuance shown on
the Addenda. Revisions, except for revisions to material
specifications in Section II, Parts A and B, become mandatory
six months after such date of issuance, except for
boilers or pressure vessels contracted for prior to the end
of the six-month period.

It should be noted that by using vague terms such as the "latest edition" or "latest approved edition", or "latest accepted edition" or "latest adopted edition" in contract documents, there is quite alot of room for interpretation depending on the regulatory or enforcement authority in charge of administering the requirements.

In My Opinion......It is always best to indicate the year of Edition AND Addenda as applicable. It will save yourself from the hassles of interpretation later on. But that is just my opinion. Be prepared to defend your position in any case.

So if the date on the cover of the '06 Addenda is July 1, 2006, how do you get to that addenda being mandatory in mid December rather than 1 Jan 07?

I would take the position that the '05 Addenda would be in effect in mid December '06. However the '06 Addenda may be used anytime after its issue date. Maybe I fall into the category of "...those who can't."

metengr post seems to me a very clear reply to bmoorthy's post. On 15th of December 2007, the new edition of ASME VIII issued in July 2007 is not yet mandatory, therefore the latest ASME VIII mandatory edition applicable in a contract is the 2003 edition including all the add's untill 2006. The July 2007 edition may be specified, only if agreed by the purchaser and vendor in the contract documentation.
