Response modificatior factor for a kicker

Just wonder if I can use a kicker to transfer the seismic load from a higher roof in the south of building to the shear wall under the lower roof at the north of building, at the same grid line. The seismic load will be around 25 kips transferred through the kicker.
It seems that kicker is not allowed in table 12.12-1 of ASCE 7-10.
If I can use it, what kind of response modification factor should I use for the kicker?

I'd consider the kicker to be part of your collector system and assume that the lateral system for the combined structure is the shear wall.
