U-2(g) Interpretation question

I would like someones interpretation of U-2(g) in the following case.

In a Sec VIII Div. I vessel, A 48" nozzle design is failing the reinforcement requirements of Appx. 1-7(b) and 1-10.

However, it will pass under Div. 2 part 4.5.

Question: In this case does U-2(g) allow me to ignore the failure under 1-7(b) and 1-10 and use Div. 2?

U-2(g) is in place for situations where there are NO rules in the code. In your situation, there are rules, in 1-7(b) and 1-10, so U-2(g) is not applicable.

I understand and appreciate that the nozzle reinforcement rules between the Divisions are different, and may result in the situation that you are faced with. However, you cannot pick and choose from each Division what you want. Example - there are additional inspection and NDE requirements that go hand-in-hand with the rules of Part 4.5. But, a thorough reading and understanding is required. Furthermore, the design margins in Division 2 are DIFFERENT than those in Division 1, so again you have a conflict.

There is progress (slow, but typical for ASME) being made on harmonizing many of the rules (nozzle reinforcement included) between the two Divisions. But, for right now, the answer to your question is "No".
 
Thanks TGS4. I am in agreement with you. This was a discussion between myself an another engineer. I just wanted to pose the question objectively.
