Hello peeps,

I am trying to legalize a mezzanine inside of an industrial bldg., and the city is adamant that I need to make the mezzanine ADA accessible. The mezzanine was not done under permit, but he rooms under the mezzanine were ( The mezzanine is just an extension of rooms constructed downstairs). The bldg. is fully accessible downstairs with everything done under permit. The million dollar question is can the city obligate my client to make the mezzanine ADA accessible? Has anyone dealt with this before? Can anyone please help...

And I suppose the city could have their own ADA requirements in excess of what is found online...

We'd need to know a lot more detail to help: What is the use classification of the building? What is the use or uses of the mezzanine? What is the area of the mezzanine? These are just a few of the questions that need to be answered. In general, the ADA allows some limited functions on mezzanines without full accessibility. California may add additional requirements on top of the federal ones. Also, be aware that the ADA is a federal law. So, even if the local building official permits the mezzanine to be used, if the space doesn't fully meet ADA requirements the business may still be subject to prosecution under the federal law if someone feels discriminated against (ie a disgruntled employee). It'd be best to get a local architect to help navigate this one.
