Composite beam shear studs partial shear connection

In BS5950-3 there is a limitation on the minimum number of shear studs allowed being 40% of the amount required for full plastic shear connection. I believe AISC has a similar limitation. I am checking a building we are doing alterations on and I have only 30% of studs required for full shear connection so does it not comply with the code. The thing is that the composite section capacity is adequate with the lower shear capacity so it can't fail. Then we are cutting holes next to some beams which reduces the effective concrete cross section and thereby reduces the number of studs that would be required for full connection so perversely making the beam compliant with the rules of the code! Am I missing a trick.

The other thing is that some of the holes are closer to the line of studs than 300mm. The code requires edge U bars to prevent splitting of the slab edge. Could I do this instead with a steel plate resin anchored into the edge of the slab?
