Extra Joint In Curb Angle

We have observed local ovality in shell during Rafter installation and to avoid installation under stress we had cut angle as shown in attached image.

Can we justify with code requirements or any other method.

The completed shell and top angle need to meet the tolerances of API-650. There's not anything requiring or prohibiting specific steps to get there. Cutting the angle and re-welding might introduce a peaking effect in the shell below, but if all meets tolerances, it should be okay.
 
Did you try to reduce / remove the ovality in the shell by hammering / localized heating (upto 250[sub]0[/sub]C)?

Get the rafter drawing re-verified by the design engineer (whether it could still take the weight of the roof after the cut angle).
