I have a 12-story open garage with retail stores beneath on the 1st floor. Waterproofing was shown to be on level 2 of the garage however, it got a valve engineered out. Is there anywhere in the code that would require the 2nd floor, which is the roof of the retail space, to be watertight? The separation is 2hr rated and has sprayed insulation on the underside however I think water eventually would penetrate through the floor into the retail space. Would the 2nd floor be considered a roof for the retail space? Need some code references if any as this will be a big fight at this point if required.

Is this value engineering authorized by the owner? Did the Engineer of Record sign off on the value engineering?
Here is a link to the relevant section of the IBC.

A concrete deck can be leak tight if if is free of cracks and joints. It is common for car parks to be dependent on hundreds to thousands of feet of caulk to obtain water tightness. The caulk will work for a while, but eventually leaks are inevitable.
