Scrubber spray nozzle - pressure retaining component?

In regards to B31.3 pressure piping supplying normal fluid category service into a scrubber tank (scrubber open to atmosphere), if the back pressure form the spray nozzle is greater than 15 psig, does the piping and nozzle downstream of the last valve fall under ASME VIII/B31.3 or is it non-code as the nozzle is technically open to atmosphere? Any code interpretation references or opinions would be greatly appreciated.

Downstream of the last valve it is noncode piping, and the nozzle itself is noncode. You can dig out the code reference for yourself.
