Toe guard on guard rails 2

Good Morning fellow engineers,

I am working on a toe guard of guard rail the code requirements says

The toe guard shall be securely fastened and have a height not less than 100mm (4") above the working surface.

My question is if I run a Unistrut 1 5/8" as a toe guard and leave 2 3/8" between surface and bottom of Unistrut. I am satisfying the 4" above working surface criteria. Is it code compliant?
IS there any document clearly saying that it should be a flat plate and must touch the working surface?

the intent of a toe guard is to prevent objects from falling on workers below, leaving a large gap between the surface and rail you are proposing doesn't seem like it would fulfill it's purpose.

I agree with Celt - I usually specify a 4" angle or flat bar (depending on support conditions and spacing) as a toe guard/toe kick. I'll specify enough of a gap so the walkway won't hold water, but that's about it.

Toeboards. Toeboards shall be provided when employees below could be exposed to falling objects such as tools. The intent that there shall be minimal gap between the bottom edge of the toeboard and the flooring is pretty clear
