This sounds like you're trying to ask a scope question. The SCOPE of ASME Section VIII includes vessels above 15 psig. But there is nothing stopping you from applying the Code to vessels under 15 psi.
jte is correct, though, you have to understand the rules that are applicable where you are going to operate the vessel. The jurisdiction may require ASME vessels for your service.
I believe the answer is yes however the responsibility belongs with the end user that they install and opearate equipment according to the local codes which can vary from state to state and could alse depend on the local city inspectors.
From a manufacturing standpoint it would be prudent to verify this with the end user before the unit is designed and constructed.

Whatever is the going around this hot topic, the answer is simple: yes, it is a dangerous pressure vessel which must be designed and fabricated to the requirements of ASME BPVC Section VIII Division 1. The stamping is optional or mandatory in accordance with the rules of the state you intend to use the vessel. In any case, you must receive from the accredited pressure vessel fabricator (not a shonky backyard manufacturer) the appropriate documentation and markings/nameplate in accordance with the code.
Otherwise, it's almost certain you'll end up in trouble with the law.
