Notice of Project requirements - industrial

Hi - not sure if this is the right place for this question, but I figured I’d give it a shot.

Ideally if you have experience in Ontario, that would be helpful! I’m trying to determine when a notice of project (NOP) applies on an industrial site. If labour + material costs exceed $50k for a non automotive plant, you need an NOP. In a large repair project, it seems the activity should be covered by construction regs as opposed to industrial. My question is - do you consider the cost of the part being replaced as a “material”? So - if I’m replacing a large screw as part of a screw conveyor and the screw costs more than $50k, do I need an NOP?

Direct from section 6(1) of the Regulation for Construction Projects, O. Reg 213/91
A Notice of Project is required if:
a) The project has a total cost of labour and materials expected to exceed $50,000 or $250,000 if the project is confined to a factory that manufactures or assembles automobiles;
b) The work is the erection or structural alteration of a building more than two storeys or more than 7.5 metres high;
c) The work is the demolition of a building at least 4 metres high with a floor area of at least 30 square metres;
d) The work is the erection, structural alteration or structural repair of a bridge, an earth-retaining structure or a water-retaining structure more than 3 metres high or of a silo, chimney or a similar structure more than 7.5 metres high;
e) Work in compressed air is to be done at the project;
f) A tunnel, caisson, cofferdam or well into which a person may enter is to be constructed at the project;
g) A trench into which a person may enter is to be excavated at the project and the trench is more than 300 metres long or more than 1.2 metres deep and over 30 metres long;
h) The work is the construction, over frozen water, slush or wetlands, of an ice road for vehicles, machinery or equipment; or
i) A part of the permanent or temporary work is required by this Regulation to be designed by a professional engineer.

According to your original post, part of the project is to replace a (expensive) part of a conveyor, under which of the other sections (b-i) does the project fall?
By itself, the part meets or exceeds the commercial aspect of a) - without including labor by the sounds of it. My read is that means most likely a NOP, but if you hit on one of the other categories, it will DEFINITELY mean a NOP.
 
I would not consider replacement of a part in an industrial machine to be a “construction project”.
 
Clarifying my earlier post - replacement of one or more specific parts within a machine (e.g. screw for screw conveyor) does NOT constitute a need for NOP. However, if the project involves other work (civil engineering for structures, hazardous locations such as enclosed spaces, or it involves sensitive environmental issues like wetlands and/or water table) ... it does need a NOP.
