Referring to the attached image, would you consider this a tension lap?

AS3600 does not seem to cater for this scenario.

Personally I do not think the bars are lapped in tension.

However there will be strut tie or flexural action (depending on geometry) between the two bars so provided that there is enough PT/reo forces will be transferred.

In practice this is not easy to justify. If this assumption is correct how would one justify it?

Yes, provided the band beam is sufficiently reinforced.
 
It is a tension lap, but it adds a moment to the joint. The members meeting at that node must be capable of resisting the new moment in addition to all other forces and moments occurring at that joint.
