A sketch would be helpful, it is difficult to understand what you mean and there are other bits of information that are relevant to the question - What kind of sheathing and how many layers? Is this for top-of-wall or bottom-of-wall? If I understand the question correctly, you are asking if the builder can drive their screws through the sheathing to penetrate both members and still act in the same way as a screw installed before the sheathing is applied; is that right?
If it's a top of wall connection with a deflection track, obviously you wouldn't want to create a positive connection between the sheathing and the deflection track.
If it's a bottom of wall connection, you may be ok if you're not using both legs for the stud-to-track connection calc. If you ARE using both legs, you would probably want the head of the screw in contact with both legs or change the equation you're using so you only utilize a single leg.
